Employer claims / Article 3

Answer the claim notice.

The deadline, what happens if you miss it, and what a clear response includes.

When a former employee files for unemployment, the state sends the employer a notice asking about the separation. It looks like routine paperwork. It is the one chance most employers get to put their side on record before the state decides.

The deadline is short

Each state sets its own response deadline. A few examples from the states' own guidance:

  • California: 10 calendar days from the mail date printed on the notice.
  • Virginia: 10 calendar days.
  • South Carolina: 10 calendar days from receiving the notification.
  • Texas: 14 calendar days from the date the notice is mailed.

In some states the clock starts when the notice is mailed, not when you open it. Your notice shows the exact deadline. That is the date that counts.

What happens if you miss it

If the state does not hear from you, it decides using the claimant's statement alone. In some states a late response costs more than that. In Texas, an employer who does not respond within 14 days is not an interested party to the claim and loses its appeal rights. In Virginia, since July 1, 2025, a late or inadequate response can also lead to the loss of appeal rights.

What a clear response includes

  • The dates of hire and separation
  • The reason for the separation, in plain words: laid off, quit, or discharged
  • If the person quit: when, how, and what they said, with the message if there is one
  • If the person was discharged: the final incident, the policy, and any earlier written warnings
  • Copies of the documents that back each point

Specific facts carry more weight than general statements. "Absent without notice on March 3, 4 and 7 after a written warning on February 20" says much more than "poor attendance".

How to send it

Many states accept responses through SIDES, the state's employer portal, or by mail or fax using the form that came with the notice. Use the method your notice lists, and keep proof of when you sent it.

Be accurate, even when it does not help you

If the separation was a layoff, say so. An accurate response protects your credibility for the claims you do need to contest. Quit, fired or laid off: who qualifies

Zenmul prepares the written response with the facts, dates and documents lined up, usually within 24 to 48 hours of receiving everything. You submit it yourself.
